These Terms govern your purchase and use of Unshifty (the “Software”), a native macOS teleprompter application, and the website at unshifty.com (the “Site”), operated by the Unshifty team (“we”, “us”). By downloading, installing, or paying for the Software you agree to these Terms. If you don't agree, don't install or use the Software.
1. Licence
When you purchase Unshifty we grant you a personal, non-exclusive, non-transferable licence to install and use the Software on Macs that you own or control, for your own creative work, whether personal or commercial. You may not resell, sublicense, rent, or redistribute the Software, nor reverse-engineer it except to the extent applicable law expressly permits.
2. Trial
Unshifty includes a 3-day trial. The trial clock starts the first time you actually read with the prompter, not when you launch the app. No payment card is required during the trial. After the trial ends the prompter functionality is locked until you purchase a licence.
3. Payment, billing, and merchant of record
Purchases are processed by Lemon Squeezy, who acts as the merchant of record for the transaction. That means Lemon Squeezy handles payment, tax collection, invoicing, and chargebacks. Their Terms of Service and Privacy Policy apply to the payment portion of your purchase in addition to these Terms.
Prices are shown in USD unless otherwise stated. Applicable VAT, GST, or sales tax is added at checkout based on your billing location.
4. Pricing tiers
The base licence is a one-off payment for the current major version of the Software. The optional AI Rewrite add-on is a monthly subscription, billed in advance through Lemon Squeezy; you may cancel at any time from the customer portal link in your receipt, and your add-on access continues until the end of the paid period.
5. Refunds
Because we offer a free, fully-functional trial before purchase, we generally do not issue refunds for the one-off licence once the trial has been used. If the Software is fundamentally broken for you on a supported configuration (macOS 14+ on Apple Silicon) and we are unable to fix the issue in a reasonable time, contact us at hello@unshifty.com within 14 days of purchase and we will refund in full. Statutory consumer rights in your jurisdiction are not affected by this section.
6. Updates
Bug-fix and minor updates to the version you purchased are included in your licence. Future major versions of the Software may require an upgrade purchase; we'll communicate that clearly before release. We may add, change, or remove features over time without prior notice.
7. Your content and privacy
Scripts you load into Unshifty stay on your device. The Software does not upload your scripts to our servers. The optional “Smart Cleanup” runs on-device. If you use the paste-ready prompt to send a rewrite request to a third-party LLM, that request is handled by the provider you chose, under their terms and privacy policy, not ours.

8. Acceptable use
You agree not to use the Software to create or distribute content that is unlawful in your jurisdiction, that infringes third-party rights, or that is intended to harass or defraud others. We can terminate your licence for material breach of these Terms.
9. Disclaimer of warranties
The Software and the Site are provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be error-free or that it will meet every workflow you might try.
10. Limitation of liability
To the maximum extent permitted by applicable law, our aggregate liability arising out of or related to the Software or these Terms is limited to the amount you actually paid us for the Software in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost recordings, lost time, or lost revenue. Nothing in these Terms limits liability for matters that cannot be limited under applicable law.
11. Third-party services
The Software and Site may link to or interoperate with third-party services (for example, Lemon Squeezy for checkout, GitHub for downloads, or LLM providers for the rewrite handoff). We're not responsible for those services. Your use of them is governed by their own terms.
12. Changes to these Terms
We may update these Terms from time to time. The version posted at unshifty.com/terms is the current version. Material changes will be announced on the Site or via the email address attached to your purchase. Continued use of the Software after the change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Australia, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located in Australia, except where mandatory consumer law in your country of residence requires otherwise.
